Welcome to EMT OnScene. These Terms of Service ("Terms") constitute a legally binding agreement between you and EMT OnScene ("we," "our," or "us") governing your access to and use of our website, mobile applications, and services (collectively, the "Service").
By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

EMT OnScene provides an educational training platform for Emergency Medical Technicians (EMTs) featuring:
- Realistic emergency medical scenarios across multiple categories (cardiac, trauma, respiratory, neurological, medical, obstetric)
- Interactive quiz-based learning with multiple-choice questions
- Detailed explanations and educational content
- Progress tracking and performance analytics
- Cloud-based storage of user progress and statistics
The Service is provided free of charge. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.
4. Educational Purpose and Medical Disclaimer
IMPORTANT: Educational Use Only
The Service is for educational and training purposes only. The content, scenarios, and information provided through EMT OnScene:
- Are NOT a substitute for professional medical training, certification programs, or formal EMT education
- Do NOT constitute medical advice, diagnosis, or treatment
- Should NOT be relied upon in actual emergency situations
- May not reflect the most current medical protocols or guidelines
- Should be supplemented with official training materials and protocols from your local jurisdiction
You acknowledge and agree that:
- EMT OnScene is a supplemental study tool designed to enhance your knowledge and test-taking skills
- You must always follow your local protocols, medical direction, and scope of practice
- In real emergency situations, you must rely on your official training, certification, and protocols
- We make no representations or warranties regarding the accuracy, completeness, or timeliness of the educational content
- You assume all risk and responsibility for your use of the Service and any decisions made based on the content
5. User Conduct and Prohibited Activities
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Violate any applicable federal, state, local, or international law or regulation
- Impersonate or attempt to impersonate any person or entity
- Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service
- Use the Service in any manner that could disable, overburden, damage, or impair the Service
- Use any robot, spider, scraper, or other automated means to access the Service
- Attempt to gain unauthorized access to any portion of the Service, other accounts, computer systems, or networks

The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, design, selection and arrangement, and scenarios) are owned by EMT OnScene, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
6.2 Limited License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial, educational purposes only.
6.3 Restrictions
You may not:
- Use the Service or its content for any commercial purpose
- Reproduce, distribute, modify, create derivative works of, publicly display, or publicly perform any content from the Service

You retain all rights to your quiz responses and performance data. However, by using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use anonymized and aggregated data for:
- Improving the Service and developing new features
- Analyzing usage patterns and trends
- Research and analytics purposes
8. Third-Party Services
The Service utilizes third-party services, including:
- Amazon Web Services (AWS) for hosting, authentication, database, and API services
- Google, Facebook, and Apple for social authentication

9. Disclaimers and Limitations of Liability
9.1 No Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
We do not warrant that:
- The Service will function uninterrupted, secure, or error-free
- Defects will be corrected
- The Service or the servers that make it available are free of viruses or other harmful components
- The Service will meet your requirements or expectations
- The educational content is accurate, complete, current, or suitable for your specific needs
9.2 Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EMT ONSCENE, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to or use of or inability to access or use the Service
- Any conduct or content of any third party on the Service
- Any content obtained from the Service
- Unauthorized access, use, or alteration of your transmissions or content
- Errors or omissions in any content or any loss or damage incurred as a result of the use of any content
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID US IN THE LAST SIX (6) MONTHS, OR, IF GREATER, ONE HUNDRED DOLLARS ($100).
9.3 Medical Liability Disclaimer
WE SPECIFICALLY DISCLAIM ANY LIABILITY FOR MEDICAL DECISIONS OR PATIENT CARE OUTCOMES. You acknowledge that EMT OnScene is an educational tool and cannot replace proper medical training, judgment, or protocols. Any actions you take based on information from the Service are at your own risk.
10. Indemnification
You agree to defend, indemnify, and hold harmless EMT OnScene, its affiliates, licensors, and service providers, and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
- Your violation of these Terms
- Your use of the Service
- Your violation of any rights of another person or entity
- Any medical decisions or patient care actions you take based on content from the Service
11. Account Termination
11.1 Termination by You
You may terminate your account at any time by contacting us or using the account deletion feature if available. Upon termination, your right to use the Service will immediately cease.
11.2 Termination by Us
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you:
- Breach these Terms
- Engage in prohibited activities
- Provide false or misleading information
- Engage in fraudulent or illegal activities
11.3 Effect of Termination
Upon termination:
- Your right to access and use the Service will immediately cease
- Your account data may be deleted in accordance with our data retention policies
- All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability
12. Modifications to the Service and Terms
12.1 Service Modifications
We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.
12.2 Terms Modifications
We may revise and update these Terms from time to time at our sole discretion. All changes are effective immediately when posted and apply to all access to and use of the Service thereafter.
Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes. We will update the "Last Updated" date at the top of these Terms. You are expected to check this page regularly so you are aware of any changes.
13. Dispute Resolution and Arbitration
13.1 Informal Resolution
If you have any dispute with us, you agree to first contact us and attempt to resolve the dispute informally by sending written notice to the email address provided in the "Contact Us" section below.
13.2 Binding Arbitration
If we cannot resolve a dispute informally, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be settled by binding arbitration in accordance with the American Arbitration Association's rules, rather than in court, except that you may assert claims in small claims court if your claims qualify.
The arbitration will be conducted in the United States, and judgment on the arbitration award may be entered in any court having jurisdiction thereof. You and EMT OnScene agree that any arbitration shall be limited to the dispute between you and EMT OnScene individually.
13.3 Class Action Waiver
YOU AND EMT ONSCENE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
14. Governing Law and Jurisdiction
These Terms and any dispute or claim arising out of or related to these Terms or the Service shall be governed by and construed in accordance with the laws of the United States and the State in which EMT OnScene is registered, without regard to its conflict of law provisions.
Any legal action or proceeding related to your access to or use of the Service shall be instituted in a federal or state court located in the applicable jurisdiction. You agree to submit to the personal jurisdiction of such courts.
15. General Provisions
15.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and EMT OnScene regarding the Service and supersede all prior agreements and understandings.
15.2 Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
15.3 Waiver
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
15.4 Assignment
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
15.5 No Third-Party Beneficiaries
These Terms do not and are not intended to confer any rights or remedies upon any person or entity other than you and EMT OnScene.
15.6 Force Majeure
We shall not be liable for any failure to perform our obligations under these Terms where such failure results from any cause beyond our reasonable control, including but not limited to mechanical, electronic, or communications failure or degradation.
